R v. P.L. Shotgun Discovered in Search of Vehicle - Charges Withdrawn

Charges: Possession of Loaded Sawed-Off Shotgun and related charges

Result: Charges withdrawn

 

P.L. was charged with possession of a loaded sawed-off shotgun that was discovered in the back of her car.  The police reveived a tip that a gun was in the car and performed a high risk take down, arresting P.L. and seizing the gun.

 

Following several meetings with the judge and prosecutor, Mr. Rolfe had P.L.'s charges withdrawan.  

R v. D.M. Firearm discovered in search warrant execution.

Charges: Possession of Loaded Handgun (and related charges)

Result: Charges withdrawn

 

D.M. was one of two individuals present during the execution of a search warrant, in which a handgun was discovered in a pair of jeans, near the accused.  Mr. Rolfe successfully negotiated for the charges to be withdrawn by the prosecution.  

 

 

R v. D.K. Discharge after loaded gun found in client's car.

Charges: Possession of Loaded Handgun (and related charges)

Result: Client discharged after preliminary hearing

 

D.K. was driving a vehicle that was pulled over by the police.  The car contained a loaded handgun.  Mr. Rolfe successfully argued to the judge that there was no evidence that D.K. had knowledge or control of the firearm.  The judge agreed, discharging D.K. on all counts.

 

 

R v. R.S. Discharge after two handguns and ammunition found during search warrant execution.

Charges: Possession of firearm X 2 (and related charges)

Result: Client discharged after preliminary hearing

 

Two firearms were located when Toronto Police executed a search warrant on an apartment.  R.S. was present in the apartment.  Mr. Rolfe successfully argued that there was no evidence that R.S. had knowledge or control of either firearm.  R.S. was discharged on all counts.
